Terms and Conditions for Using NavyXo Services

1. ACCEPTANCE OF TERMS
By using the NavyXo mobile application and related services ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. SERVICE DESCRIPTION
NavyXo provides a rider safety platform that includes:
- Real-time location tracking during rides
- Automatic fall detection using device sensors
- Emergency contact notification
- Route planning and sharing
- Live ride tracking
3. USER OBLIGATIONS
- Provide accurate and up-to-date information
- Maintain the security of your account password
- Use the Service only for lawful purposes
- Not abuse emergency features for false alarms
- Ensure emergency contacts have consented to receive notifications
4. LIMITATIONS OF LIABILITY AND DISCLAIMER
NavyXo IS NOT AN EMERGENCY SERVICE and is not a substitute for calling the emergency number (112 in the European Union). In an emergency, call the emergency services first. Never rely on the App alone.
Fall detection reads the sensors of an ordinary phone and cannot recognise every incident. Whether an incident is detected depends on where the phone is carried, the model and condition of its sensors, the battery level, power-saving and background restrictions imposed by the operating system, and on the movement itself. The App may miss a real fall and may report a fall that never happened.
Alerts to your emergency contacts travel over mobile networks and third-party providers for SMS, voice calls, messaging and e-mail. They may be delayed, degraded or fail entirely for reasons outside our control, including missing coverage, a flat battery, a blocked or unreachable recipient, and provider outages. A contact who has not given consent is not alerted at all.
The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or uninterrupted and error-free operation.
To the fullest extent permitted by applicable law, Info Media d.o.o. is not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of life, personal injury, damage to property, lost profit or lost data arising from use of or inability to use the Service, from a failure to detect an incident, or from an alert that was delayed, incomplete or never delivered.
Where liability cannot be excluded, it is limited to the amount you actually paid for the Service in the twelve (12) months before the event giving rise to the claim. Nothing here excludes liability for death or personal injury caused by our gross negligence or wilful misconduct, or any other liability that cannot be excluded under the mandatory law of the Republic of Croatia.
YOUR RESPONSIBILITIES
- Ride lawfully and safely, wear the protective equipment the law requires, and mount your device so that it does not obstruct you.
- Keep the battery charged, the permissions granted and the App updated - without them detection and alerting cannot work.
- Test the App and your emergency contacts before you rely on them, and test again after changing phone, contacts or settings.
- Obtain the consent of every emergency contact before adding them, and tell them what they will receive.
- Call the emergency services yourself whenever you are able to.
5. SUBSCRIPTIONS AND PAYMENTS
- Free Plan: Basic features with limitations
- Premium Plans: Advanced features with monthly/yearly billing
- Payments are processed securely via Stripe
- Refunds in accordance with our refund policy
6. TERMINATION
We may suspend or terminate your account for violation of these terms. You may delete your account at any time through the app settings.
7. GOVERNING LAW
These terms are governed by the laws of the Republic of Croatia. All disputes will be resolved in the courts of Pula, Croatia.
